Data protection is very important to us and we take this issue very seriously. We have therefore obligated our employees to maintain secrecy about all personal and family matters regarding the child in our care. This obligation also applies after expiry of the contract.

 

In order to fulfil our information duties in accordance with Art. 12 et seq. of the General Data Protection Regulation (GDPR), we are pleased to present our information on data protection below:

Which of your data will be processed by us? And for what purposes?

If we have received data from you, we will only process it for the purposes for which we have received or collected it.

 

Examples of data that we process include: contract data, children’s master data, care information, information on parents/legal guardians and relatives, medical data, information on language development/education, integration, inclusion, as well as language and origin, bank account data.

 

Data processing for other purposes can only be considered if the necessary legal requirements pursuant to Art. 6 para. 4 GDPR have been met. In this case, we will, of course, comply with any information obligations pursuant to Art. 13 para. 3 GDPR and Art. 14 para. 4 GDPR.

 

On what legal basis is this done?

In the absence of specific legal provisions, the legal basis for the processing of personal data is Art. 6 GDPR.

 

  • Consent (Art. 6 para. 1 (a) GDPR)
  • Data processing for the performance of contracts (Art. 6 para. 1 (b) GDPR)
  • Data processing on the basis of a balancing of interests (Art. 6 para. 1 (f) GDPR)
  • Data processing for compliance with a legal obligation (Art. 6 para. 1 (c) GDPR)

 

If personal data is processed on the basis of your consent, you have the right to revoke this consent at any time with immediate effect for the future.

 

If we process data on the basis of a balance of interests, you as the data subject have the right to object to the processing of personal data, taking into account the provisions of Art. 21 GDPR.

 

How long is the data stored?

We process the data as long as this is necessary for the respective purpose.

To the extent that legal retention duties exist - e.g. in commercial law or tax law - the relevant personal data is stored for the duration of such retention duty. After expiration of the retention period, it is examined whether further processing is necessary. If the requirement no longer exists, the data is deleted.

 

As a matter of principle, we perform a review of data regarding the need for further processing towards the end of each calendar year. Due to the amount of data, this review is carried out with regard to specific data types or purposes of processing.

 

You can, of course, at any time (see below) request information about your personal data stored by us. Should the necessity no longer exist, you can request deletion of the data or a restriction of its processing.

Which recipients will the data be passed on to?

Your personal data will only be passed on to third parties if this is necessary for the performance of the contract with you, if passing on such data is permissible on the basis of a balancing of interests within the meaning of Art. 6 para. 1 (f) GDPR, if we are legally obliged to pass on such data or if you have given your consent thereto.

 

In particular, § 12 para. 1 KiBiz (the child education law of the State of North Rhine-Westphalia) requires us to communicate the surname and first name of the child, the date of birth, gender, nationality, family language as well as the surnames, first names and addresses of the parents/guardians. According to § 12 para. 2 KiBiz, the data may only be made accessible to those persons who require it for the fulfilment of duties under KiBiz.

 

For the purposes of planning and statistics in the area of day care facilities for children, anonymised data may be transmitted to the State Office for Information and Technology of North Rhine-Westphalia, to the supreme state youth authority and to the supra-local public youth welfare agency in accordance with § 12 para. 3 KiBiz and §§ 47, 98 et seq. SGB VIII (Book Eight of the Social Security Code). It may furthermore be processed for quality development and quality improvement measures. This anonymisation means that the identification of individual persons is no longer possible.

 

In order to determine the language level in accordance with §36 para. 2 of the School Act of North Rhine-Westphalia, §14 para. 3 KiBiz requires Tree House Swans gGmbH to forward the child’s surname and first name, date of birth, gender, family language, date of admission to the day care centre as well as the surnames, first names and addresses of parents/guardians to the competent education authority.

 

Where is the data processed?

Your personal data will only be processed by us on our premises or in data processing centres within the Federal Republic of Germany.

 

Your rights as a “data subject”

You have the right to receive information about the personal data processed by us about you as a person.

 

In the case of a request for information which is not made in writing, please understand that we may then require proof from you that you are the person you claim to be.

 

You furthermore have a right to correction or deletion of data or to a restriction of the processing to the extent to which this is legally permissible.

 

Moreover, you have the right to object to the processing within the scope of the statutory provisions. The same applies to your right to data portability.

 

In particular, you have a right to object to the processing of your data in connection with direct marketing pursuant to Art. 21 para. 1 and 2 GDPR if this is done on the basis of a balancing of interests.

 

Right of appeal

You have the right to file a complaint about the processing of personal data by us with a data protection authority.
